These Terms of Service (“Terms”) are a binding agreement between you and Fast Foreclosure Data(“we,” “us,” or “our”) governing your use of the Fast Foreclosure Dataplatform, website at fastforeclosuredata.com, APIs, data exports, email notifications, and related services (collectively, the “Service”).
By creating an account, starting a trial, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of a company, you represent that you have authority to bind that company, and “you” refers to that company.
1. What The Service Is
Fast Foreclosure Datais a data intelligence platform for real estate professionals. We monitor publicly available county records — primarily foreclosure filings such as Notices of Trustee's Sale — and use automated systems, including optical character recognition and artificial intelligence, to extract, structure, and deliver that information through dashboards, search, saved searches, watchlists, email alerts, exports, and AI-generated summaries and chat.
The Service is a research and monitoring tool for business use. It is not a substitute for the official records maintained by county clerks or other government offices.
2. Public Records; No Warranty Of Accuracy
All property, filing, and party information in the Service is derived from records made publicly available by government offices. Those records may contain errors, may be filed late, amended, withdrawn, or rescinded, and our automated collection and extraction may itself introduce errors, omissions, or delays. Accordingly:
- We do not warrant that any data in the Service is accurate, complete, current, or fit for any particular purpose.
- Confidence scores, extraction flags, and similar indicators are informational aids only, not guarantees.
- Before acting on any information from the Service — including bidding at a foreclosure sale, contacting a party, or making any financial commitment — you must independently verify the information against the original records at the relevant county office.
Fast Foreclosure Data is not affiliated with, endorsed by, or acting on behalf of any state, county, or other government entity.
3. No Legal, Financial, Or Investment Advice
Nothing in the Service — including AI-generated briefs, summaries, or chat responses — constitutes legal, financial, tax, or investment advice, or a recommendation to buy, sell, or bid on any property. Foreclosure investing involves substantial risk, including total loss of invested capital, title defects, occupied properties, and redemption rights. You are solely responsible for your decisions and should consult licensed professionals (attorneys, title companies, financial advisors) before acting.
4. AI-Generated Content
Portions of the Service are produced by artificial intelligence, including document extraction, property briefs, and chat features. AI output can be incomplete, outdated, or simply wrong, even when it appears confident. AI-generated content is provided for convenience only, is not reviewed by a human before delivery, and is subject to the same verification obligation described in Section 2.
5. Not A Consumer Reporting Agency (FCRA)
Fast Foreclosure Data is not a consumer reporting agencyas defined by the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. (“FCRA”), and the Service does not constitute a “consumer report.”
You may not use the Service, in whole or in part, to determine any person's eligibility for credit, insurance, employment, housing or tenancy, government benefits or licenses, or for any other purpose covered by the FCRA. You agree not to use the Service to harass, stalk, threaten, or otherwise harm any individual named in a public record.
6. Accounts And Eligibility
- You must be at least 18 years old and able to form a binding contract.
- You must provide accurate registration information and keep it current. You may sign in with an email and password or through a supported third-party identity provider (e.g., Google).
- You are responsible for safeguarding your credentials and for all activity under your account.
- Each subscription is for a single named user unless your plan or a separate written agreement expressly permits otherwise. Sharing credentials, pooling access, or rotating a seat across multiple people is prohibited.
- Notify us promptly at support@fastforeclosuredata.com if you suspect unauthorized use of your account.
7. Subscriptions, Trials, And Billing
Plans. We offer paid subscription plans that differ in county coverage and features (for example, number of counties monitored, bulk export, AI features, and support level). Current plans and prices are shown on our pricing page and may change as described in Section 15.
Free trial. New subscriptions may include a free trial (currently 7 days). A valid payment method is required to start a trial. Unless you cancel before the trial ends, your subscription begins automatically and your payment method is charged for the first billing period.
Billing. Subscriptions are billed monthly in advance through our payment processor, Stripe. You authorize recurring charges to your payment method until you cancel. Prices are in U.S. dollars and exclusive of any applicable taxes, which you are responsible for.
Plan changes. Upgrades take effect immediately and may be prorated; downgrades take effect at the next billing cycle. Downgrading may reduce your county coverage and disable features; data associated with removed coverage may become inaccessible.
Cancellation and refunds. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you retain access until then. Except where required by law, payments are non-refundable and we do not provide credits for partial billing periods or unused service.
Failed payments. If a charge fails, we may retry it and may suspend or terminate access until payment is made.
8. Acceptable Use
You agree not to, and not to permit any third party to:
- scrape, crawl, spider, or harvest the Service by automated means, or bypass rate limits, access controls, or authentication;
- resell, sublicense, redistribute, publish, or make available the Service or its data to third parties, whether free or paid, except as expressly allowed under Section 9;
- use the Service or its data to build, train, or improve a competing product or dataset, including training machine-learning models on our data;
- misrepresent data from the Service as your own original research or as an official government record;
- use the Service for any purpose prohibited by Section 5 (FCRA) or by applicable law, including laws governing debt collection, telemarketing (TCPA), and text/email solicitation (CAN-SPAM);
- interfere with or disrupt the Service, probe or test its vulnerabilities without written authorization, or introduce malicious code;
- share, lend, or transfer account access in violation of Section 6.
We may investigate suspected violations and may suspend or terminate accounts as described in Section 14.
9. Data Exports And Permitted Use
Where your plan includes export functionality, you may download data (e.g., CSV) for your own internal business use — analysis, underwriting, deal sourcing, and record-keeping within your organization.
You may not redistribute exported data as a standalone dataset or product, publish it in bulk, or provide it to third parties (including clients) except as incidental, non-systematic excerpts embedded in your own work product. Your rights to exported data survive termination only for exports made while your subscription was active; the restrictions in this Section and Sections 5 and 8 survive indefinitely.
10. Intellectual Property
We own all right, title, and interest in and to the Service, including the software, design, database structure and compilation, extraction methodology, AI-generated enrichments, confidence scoring, documentation, and trademarks (including “Fast Foreclosure Data”). These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service during your subscription, and no other rights.
The underlying public records themselves are not owned by us, and nothing in these Terms restricts your independent access to records directly from government sources.
If you send us feedback or suggestions, we may use them without restriction or compensation.
11. Third-Party Services
The Service depends on third-party providers, including payment processing (Stripe), identity providers (e.g., Google sign-in), email delivery, cloud hosting, and AI model providers. Your use of third-party services is governed by their own terms, and we are not responsible for their acts, omissions, or outages. Charges for your subscription may appear on your statement under our payment descriptor as shown at checkout.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL CAPTURE EVERY FILING, THAT NOTIFICATIONS OR ALERTS WILL BE DELIVERED OR DELIVERED ON TIME, OR THAT DATA WILL BE CORRECT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Limitation Of Liability; Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY; AND (b) OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR ANY DECISION YOU MAKE OR ACTION YOU TAKE IN RELIANCE ON THE SERVICE, INCLUDING ANY BID, PURCHASE, OR INVESTMENT.
You agree to defend, indemnify, and hold harmless Fast Foreclosure Dataand its officers, members, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms or applicable law (including the FCRA), or decisions you make based on data from the Service.
14. Suspension And Termination
You may stop using the Service and cancel at any time. We may suspend or terminate your access immediately if you violate these Terms (including Sections 5, 8, and 9), fail to pay, or if we reasonably believe your use creates risk or legal exposure for us or others. We may also discontinue the Service or any feature with reasonable notice. Upon termination, your license ends and we may delete your account data after a reasonable period, subject to our Privacy Policy and legal obligations. Sections 2–5, 9, 10, 12, 13, 16, and 17 survive termination.
15. Changes To The Service And These Terms
We may modify the Service, plans, and prices. We may update these Terms from time to time; if a change is material, we will notify you by email or in-product notice at least 14 days before it takes effect (price changes apply from your next billing cycle after notice). Your continued use after the effective date constitutes acceptance. If you do not agree, cancel before the change takes effect.
16. Governing Law; Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Exclusive venue for any dispute lies in the state or federal courts located in [COUNTY], Texas, and you consent to personal jurisdiction there. Before filing any claim, you agree to first contact us at support@fastforeclosuredata.com and attempt in good faith to resolve the dispute informally for 30 days. To the extent permitted by law, each party waives the right to a jury trial and to participate in a class action.
17. Miscellaneous
These Terms, together with the Privacy Policy and any order or plan terms you accept, are the entire agreement between you and us regarding the Service. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, agency, or employment relationship. We are not liable for delays or failures caused by events beyond our reasonable control.
